Terms and conditions of sale

Article 1 — Purpose and scope

These general terms and conditions of sale ("Terms") govern all distance sales of products concluded between EURL VIMPERE (RCS Bordeaux 797 896 081, registered office 15 rue Gustave Courbet, 33160 Saint-Médard-en-Jalles, France, hereinafter "the Seller") and any natural or legal person placing an order on the website https://decapbloc.com or by quotation (hereinafter "the Customer"). Any order implies unreserved acceptance of these Terms, which prevail over any other document. The Seller may amend them; the applicable Terms are those in force on the day of the order.

The Customer declares having legal capacity to contract. Business customers (clubs, associations, dive centres, companies) acknowledge that certain protective provisions of the French Consumer Code, notably the right of withdrawal, do not apply to them where the purchase falls within the scope of their main activity.

Article 2 — Products

The products sold are cleaning whips for the internal maintenance of scuba cylinders, handmade by the Seller:

• Standard whip: overall length 87 cm, 1.2 mm stainless-steel strands, 12 mm coated steel shaft;
• Reverse whip: length 50 cm, 1.2 mm stainless-steel strands, 7 mm coated steel shaft;
• Kit: one standard whip and one reverse whip.

As the products are handmade, slight variations in appearance or dimensions (± 5%) may exist between items; they do not constitute a lack of conformity. Photographs and diagrams on the website are for illustration only.

The products are tools intended for use by informed persons (visual inspection technicians, clubs, divers maintaining their equipment). They must be used in accordance with the supplied instructions and the safety rules in Article 10.

Article 3 — Prices

Prices are stated in euros, all taxes included, excluding delivery costs. Delivery costs are shown before the order is confirmed and summarised in the confirmation. The Seller may change its prices at any time; the product is invoiced at the price in force when the order is confirmed.

For deliveries outside the European Union, any customs duties or local taxes remain payable by the Customer.

Article 4 — Ordering

Orders are placed online: creation of or login to a customer account, choice of products and quantities, entry of the delivery address, choice of payment method, then confirmation after checking the summary ("double click"). A confirmation e-mail summarising the order is sent to the Customer; the sale is concluded upon receipt of payment (or, for bank transfer, upon receipt of funds).

Clubs, associations and businesses may also order by quotation via the website form; the accepted quotation and pro forma invoice constitute the order.

The Seller may refuse or cancel an order in the event of a previous dispute, non-payment or unavailability of the product; the Customer is informed and refunded any sums paid.

Article 5 — Payment

Payment is made, at the Customer's choice:

• by bank card, through the secure Stripe platform; the Seller never has access to card data;
• by bank transfer, to the account indicated in the confirmation e-mail, quoting the order reference; the order is prepared upon receipt of funds. If no payment is received within 15 days, the order is cancelled.

An invoice is issued to the Customer for each order. For business customers, any late payment automatically incurs interest at the French legal rate plus 10 points and a fixed recovery fee of €40 (Article L. 441-10 of the French Commercial Code).

Article 6 — Delivery

Products are delivered to the address given by the Customer, in mainland France and the European Union, by post or carrier. Delivery costs:

Online orders are limited to 20 units per product; beyond that, a quotation is drawn up with an agreed lead time. As the products are handmade, the indicative dispatch time is 2 to 10 working days from receipt of payment, plus the carrier's transit time. In any event, delivery takes place no later than 30 days after the order unless otherwise agreed; failing this, the Customer may cancel the order and be refunded.

The Customer must check the condition of the parcel on receipt and notify any reservation to the carrier and then to the Seller within 3 days. Risk passes on handover of the product to a consumer Customer, and on handover to the carrier for a business Customer.

Article 7 — Right of withdrawal (consumers)

In accordance with Articles L. 221-18 et seq. of the French Consumer Code, consumer Customers have 14 days from receipt of the product to exercise their right of withdrawal, without giving reasons. They inform the Seller by any unambiguous means (e-mail to contact@decapbloc.com, or the form below), then return the product within the following 14 days, at their own expense, in its original packaging, complete and unused.

The Seller refunds all sums paid, including standard delivery costs, within 14 days of receiving the returned product or proof of its dispatch. A product that has been used (signs of use, deformed strands, cleaning residue) may be subject to a deduction corresponding to its depreciation.

Article 8 — Warranties

Consumer Customers benefit from the legal warranty of conformity (Articles L. 217-3 et seq. of the French Consumer Code) for two years from delivery, and from the warranty against hidden defects (Articles 1641 et seq. of the French Civil Code). Under the conformity warranty, the Customer chooses between repair and replacement, subject to the cost conditions of Article L. 217-12, and is exempt from proving the existence of the defect for 24 months. The hidden-defects warranty allows the sale to be rescinded or the price reduced within two years of discovering the defect.

Excluded from the warranty are normal wear of the strands, damage resulting from use not in accordance with the instructions (excessive speed, rotation outside the cylinder, impact, modification of the product) and lack of maintenance.

The Seller is the manufacturer of the product within the meaning of Regulation (EU) 2023/988 on general product safety; its details appear on the product or its packaging.

Article 9 — Liability

The Seller is bound by a best-efforts obligation as to cleaning results, which depend on the condition of the cylinder and the conditions of use. The Seller cannot be held liable for damage resulting from use not in accordance with the instructions and safety rules, nor for the consequences of an unfavourable visual inspection or requalification of the cylinder. The inspection and fitness decision for a scuba cylinder rest solely with the qualified technician and applicable regulations.

Towards business Customers, the Seller's liability is limited to the amount of the order concerned and excludes any indirect damage.

Article 10 — Safety rules

• Fit the whip on a drill or cordless drill with a 13 mm chuck; never exceed 1,000 rpm.
• Never run the whip outside the cylinder: insert it stopped, start only once engaged, stop the rotation before withdrawing it.
• Use on an empty cylinder, valve removed, held firmly.
• Wear safety glasses and gloves; keep all persons at a distance.
• Check the strands before each use; do not use a whip whose shaft is bent or whose sleeve is damaged.
• Keep out of reach of children.

Article 11 — Personal data

Data collected when ordering is necessary for processing, invoicing and delivery. Its processing is described in the privacy policy.

Article 12 — Retention of title

Products remain the property of the Seller until full payment of the price.

Article 13 — Governing law and disputes

These Terms are governed by French law. In the event of a dispute, the Customer first contacts the Seller's customer service (contact@decapbloc.com). Consumer Customers may use, free of charge, the consumer mediator to which the Seller belongs: CM2C — Centre de Médiation de la Consommation de Conciliateurs de Justice, 49 rue de Ponthieu, 75008 Paris — www.cm2c.net — saisine en ligne sur le site du médiateur ou par courrier, or the European Online Dispute Resolution platform (ec.europa.eu/consumers/odr). Failing amicable resolution, the French courts have jurisdiction; for business customers, exclusive jurisdiction is granted to the Commercial Court of Bordeaux.
